Vail Resorts faces third class action over Epic Pass pricing

A shareholder has filed a third class action against Vail Resorts, alleging that the pricing scheme behind its Epic Pass — already the subject of two antitrust suits — also violated securities law by misleading investors about the company's compliance with its own ethics code.

The suit claims Vail shared confidential pricing, revenue, and cost data with competitors Alterra, Boyne, and Powdr starting in 2020, producing lockstep price hikes across passes, lift tickets, rentals, and lessons. National weekend ski costs allegedly doubled to $192 a day by 2023-24, with some single-day passes hitting $356 to $385.

The complaint argues Vail also priced single-day tickets irrationally high to push customers toward the Epic Pass, a strategy CEO Robert Katz reportedly discussed with The New York Times, while his pay rose into the millions during the period in question.
