A Taiwan case in which a husband used his robot vacuum's live camera feed to catch his wife in an affair produced two separate court rulings: he won about $16,000 for infringing his marital rights, then was sentenced to five months in jail and fined roughly $4,700 for recording without consent. The authors, forensics faculty, use the case to illustrate a legal gap around always-on home devices.

Robot vacuums, smart speakers, fitness trackers and pacemakers have all supplied evidence in U.S. cases, including an Amazon Echo in an Arkansas murder case, Fitbit data upheld in a Connecticut murder conviction, and pacemaker data used against a defendant in an Ohio arson case. A 2022 leak also sent test images from an iRobot Roomba, including a woman on a toilet, to contractors who posted them in private groups.

A vacuum that maps your floor plan and streams live video was sold to you as a cleaning appliance, and somehow it ended up as evidence in a divorce and a jail sentence in the same case. Nobody read the fine print because there was a robot to watch instead. The gap the piece describes is real, and it is going to stay real until the people who write the privacy policy get asked about it under oath instead of the people who bought the gadget.
