A federal judge in Minnesota denied xAI's request to block the state's ban on AI 'nudification' tools, ruling the company failed to show irreparable harm. Judge Donovan Frank noted xAI waited three months after the law's passage to seek an injunction, undercutting its urgency claims.

The law, passed nearly unanimously, bans letting users generate nonconsensual sexualized AI images and carries penalties up to $500,000. Frank pointed to SpaceX's own $500 million litigation reserve for xAI's 'Spicy' and 'Unhinged' Grok Imagine modes as evidence the company's self-policing wasn't cutting it, and cited testimony describing over 75 women targeted with fabricated pornographic images.

A company that sets aside half a billion dollars for lawsuits over its own image generator has already told you what it expects that generator to be used for. Waiting until three days before a law takes effect to suddenly discover an emergency is the legal equivalent of showing up late to your own fire drill. The judge noticed, and so should everyone else.
