Las Vegas strip wants keys to regulating short-term rentals

A Ninth Circuit panel questioned Clark County's short-term rental licensing program, which a lower court had blocked entirely as unlawfully broad. The county, home to much of the Las Vegas Strip, has granted 175 applications and denied 141, while roughly 500 remain undecided.

Judges pressed the county's attorney on whether officials had unchecked discretion to deny licenses even when applicants meet every requirement, with one judge noting Las Vegas residents have rented out homes for decades without incident. The rental association's attorney argued the county can't impose licensing requirements and then fail to actually process them.

With the county's regulations on hold, property owners currently need no license to operate. No ruling was issued at the hearing.

A county that hands out licenses to some, denies others, and leaves five hundred people standing at the counter isn't running a system, it is running a lottery with better parking. The judges seemed to notice this before the county's own lawyer did. If you build the gate, you have to actually decide who walks through it.
