Judges snip challenge to EU climate plan before reaching the science

The EU General Court dismissed a challenge by Global Legal Action Network and Climate Action Network Europe seeking to force the European Commission to reconsider national emissions limits through 2030. Judges ruled the Commission's job was implementing targets already set by the European Parliament and member states, not revisiting the underlying goal — so the case was thrown out on procedural grounds without judges weighing whether the 2030 target is actually adequate.

The applicants had pointed to evidence, uncontested by the Commission, that deeper cuts are feasible and that the EU's current trajectory would produce roughly 3 degrees Celsius of warming if replicated globally. Western Europe just recorded its hottest June and July on record, with over 10,000 excess deaths reported across the continent in the last week of June alone.

The applicants must pay their own costs plus a third of the Commission's, though the court trimmed that share, acknowledging the Commission's own errors may have prompted the suit. They have just over two months to appeal to the Court of Justice.
