A federal court in East St. Louis, Illinois denied the state's motion to dismiss a federal lawsuit challenging the Illinois Bivens Act and the Court Access, Safety and Participation Act. The court found the federal government has standing and plausibly alleged both laws unconstitutionally burden federal immigration enforcement.

Specifically, the court noted the Bivens Act exposes federal agents to personal legal liability and punitive damages, while CASPA's 1,000-foot courthouse buffer zones interfere with agents' official duties. The case proceeds toward further litigation on the merits.

Illinois tried to give federal agents the same accountability an ordinary citizen might face for misconduct near a courthouse, and a court decided that counts as an unconstitutional burden on federal power. Somewhere, the concept of checks and balances is filing its own motion to dismiss.
