McKenna West, an Alaska surrogate who carried baby Rumi for Omar Ahmed and Nausheen Gilkar, has asked the Supreme Court to undo a California parentage order after fleeing to Texas to give birth despite the couple's decision to end the pregnancy following a diagnosis of hypoplastic left heart syndrome.

Texas courts, aided initially by the state attorney general, ordered surgery and briefly kept West in the case, but the attorney general has since withdrawn and a Texas court dismissed her under California's order. West, represented by the Alliance for Defending Freedom, argues jurisdiction should have been in Alaska and that she is being denied updates on the baby's condition.

The emergency application landed with Justice Elena Kagan, who oversees Ninth Circuit matters, and the court has not yet responded.
