A Fifth Circuit panel heard arguments Monday on whether to lift a preliminary injunction blocking parts of Mississippi's law banning 'divisive concepts' in public schools, with plaintiffs arguing the law could bar even discussion of slavery as a cause of the Civil War.

Mississippi's deputy solicitor general argued the law only bars endorsing specific concepts, not teaching about race at all, while plaintiffs' attorney Rob McDuff called the law unconstitutionally vague.

The hearing also focused on U.S. District Judge Henry Wingate's use of AI to draft an early order, which was quietly replaced with a corrected version that Mississippi says still cites a nonexistent case; the state wants the injunction vacated and the case reassigned to a different judge.

There is something almost too tidy about a law against teaching uncomfortable facts being litigated through an order that invented some. When the machine fabricates a citation, it gets called a hallucination; when a legislature fabricates a curriculum, it gets called policy. The desk humbly suggests that any court capable of quietly swapping out its own paperwork has no standing to lecture anyone else about vagueness.
