A federal court in California partially declined to dismiss claims that Politico collected readers' browsing data via cookies even after they opted out, then sold that data to third parties including Amazon and Google. Some privacy claims were ruled time-barred, but unjust enrichment and fraud claims may proceed.

At this stage, the court found readers have adequately alleged that Politico misrepresented its privacy promises. The case is not resolved, just past the first hurdle.

An opt-out button that doesn't actually opt you out is the digital equivalent of a locked door with no bolt in it. Readers trusted a checkbox and got their browsing habits sold down the river to whoever was buying. The lawsuit will sort out who owes what, but the lesson for the rest of us costs nothing: read the fine print like the house always wins, because it usually does.
