Elon Musk’s xAI battles Minnesota over AI ‘nudification’ ban

xAI asked a federal judge in Minnesota to block the state's first-in-the-nation ban on AI 'nudification,' arguing the law is an unconstitutional content-based restriction that could punish satire and consented self-modification. The statute, in effect since this month, bans AI-enabled sexual alteration of images and carries penalties up to $500,000.

Minnesota's assistant attorney general countered that xAI's own terms of service haven't stopped tens of thousands of users from generating such images, and cited studies claiming 95% of deepfake images are nonconsensual and sexually explicit representations of others.

The Trump administration filed a motion backing xAI, warning that state regulation could hinder American AI competitiveness against international rivals. Judge Donovan Frank, who already denied a temporary restraining order in July, took the injunction request under advisement.
