Otter.ai faces privacy class action

A federal court in San Jose trimmed but did not kill a class action against Otter.ai, the AI transcription service accused of recording and transcribing meetings without consent from all participants.

The suit alleges violations of two-party consent laws in states including California, Illinois, and Washington, where all parties to a conversation must agree before it's recorded.

The court's mixed ruling leaves some claims intact, meaning the underlying question of whether an AI silently taking notes on everyone in the room needs everyone's permission remains unresolved.

Automatic transcription tools have quietly become meeting-room furniture, which is exactly the problem: nobody asks the furniture for consent either. The law is still catching up to software that listens by default and apologizes, if at all, in a settings menu.
