A Maricopa County judge said she will review a sealed grand jury transcript to determine whether it shows the lead investigator in the Tom Crosby election interference case has a history of dishonesty. Special Agent Knuth, who built the case against Cochise County Supervisor Crosby, resigned from the attorney general's office in January while under investigation for filing a police report with falsified statements and for inaccurately reporting his own work hours.
That resignation now threatens to unravel the prosecution of Crosby, a Republican accused of conspiring to delay a 2022 county election canvass. The same investigator's credibility already blew up a separate perjury case against a judicial candidate, Sandra Russell, after a new grand jury declined to indict her once Knuth's testimony was gone from the record.
The judge is sorting through a procedural knot: sealed records can't be handed to Crosby directly, prosecutors say they won't call Russell as a witness so that legal door stays shut, and even a favorable in camera finding may not help Crosby's current motion. She suggested his lawyers may need to file something new entirely, built around evidence nobody disclosed until years after his indictment.
