News orgs banned from White House accuse Trump of First Amendment violation

CNN, MS Now, and Politico have asked a federal judge for a preliminary injunction to keep their White House access intact after a temporary restraining order expires October 8. The organizations sued after President Trump announced September 18 he would bar their reporters, and Secret Service officers confiscated press passes at a security checkpoint days later.

District Judge Timothy Kelly, a Trump first-term nominee, ordered the passes returned and reporters readmitted on September 23. The news organizations' 49-page brief argues the ban is retaliation for protected reporting, quoting Trump's own statement that 'other Fake News Media Outlets' would follow, and calls the administration's national security justification 'not credible.'

The brief warns that without an injunction, other outlets covering the White House could face the same treatment depending on 'the President's view of their coverage.'

A president who announces on the record that more outlets are coming for the same treatment has more or less written the plaintiffs' brief for them. That is not a national security policy, that is a mood, applied selectively to whoever files the story he does not like that week. A judge nominated by the same president is now the one deciding whether a press pass can be revoked on a whim, which tells you something about how far outside normal this has drifted.
