A federal court in Pennsylvania has ruled that two women can proceed with excessive force claims against two Philadelphia police officers who allegedly stood by while a plainclothes officer attacked them after the Eagles' Super Bowl win in February 2025.

The claim centers on failure to intervene rather than the assault itself, with the court noting the attack unfolded in stages — long enough, plausibly, for the two officers to have stepped in and didn't.

Bystander liability exists precisely because 'I didn't do anything' is not always a defense when doing nothing was the problem. The court simply declined to let that logic get thrown out before a jury hears it.
