GAO reviewed 2026 data and found 26% of qualified health plans on insurance exchanges, 1,719 of 6,655, covered non-excepted abortion services, with coverage varying heavily by state law. Federal rules require issuers to estimate this coverage's cost at no less than $1 per enrollee per month, and all 15 issuers GAO examined in 10 states reported costs below that threshold, then simply set the premium to $1 anyway.

Eleven of those 15 issuers disclose to enrollees that part of their premium covers this service, and all 15 reported the information exists somewhere in public documents. GAO also flagged instances where issuer practices may not have matched federal requirements, and as of August 2026 CMS said it would decide what to do about it depending on the facts.

When every single issuer's actual cost estimate happens to round down to the legal minimum, you don't need a forensic accountant to guess how that number got picked. CMS's response to finding possible rule-breaking, essentially 'we'll look into it depending on what we find,' is the bureaucratic equivalent of a shrug in a suit. Nineteen million people are relying on this system to be honest about what they're paying for.
