A federal court in Pennsylvania refused to dismiss an environmental group's claims that a metal fabrication company discharged polluted stormwater without required permits, in violation of federal and state clean water laws.

The group alleges the pollutants travel through municipal storm drains into the Little Neshaminy Creek and eventually the Delaware River.

The company's motion to dismiss was denied, meaning the case proceeds to further litigation on the merits.
