The Senate cleared a second procedural hurdle Thursday, 77-22, on a bill setting national rules for college athlete pay, granting the NCAA antitrust protections, creating a five-year eligibility window and barring pros from college competition. Sens. Ted Cruz and Maria Cantwell lead the effort, with Eric Schmitt and Chris Coons as original cosponsors.

Cantwell called the measure historic and said it brings reason to chaos in college sports. Critics, including Sen. Chris Murphy, argue the bill preserves what he called the exploitative model of college athletics by staying neutral on whether players are employees.

Murphy also questioned Congress's priorities, noting gas prices nearing $6 a gallon and the ongoing war in Iran. If the Senate passes the bill, the House would not act until its lame-duck session after the House already left for a seven-week campaign break.

Calling a bill historic while it dodges the one question everybody actually asks, whether these kids are employees, is like bragging about fixing the barn roof while leaving the hole in the floor. Seventy-seven votes says both parties like this arrangement just fine. The House won't even look at it until after the election, which tells you how urgent anyone truly finds it.
