Tribal group sues NFL legend over multimillion-dollar fraud scheme

Kituwah LLC, owned by the Eastern Band of Cherokee Indians, sued Emmitt Smith and business partner David Mosley in Delaware chancery court, claiming their company 4 13 Solutions defrauded it of $2.5 million meant to fund a Texas solar farm called 'Project Exodus.' Kituwah says it provided the loan in September 2023 after being promised joint control, a federal energy loan, and millions in income by the end of 2024.

None of that materialized, according to the complaint: no federal or private financing was secured, no progress on the solar farm was shown, and Kituwah says it was shut out of managing the joint venture entirely. Instead, the suit alleges, the loan money was funneled to a different investor owed funds from an unrelated prior deal — behavior Kituwah's complaint likens to a Ponzi scheme — before Smith and Mosley cut off contact.

Kituwah is seeking at least $2.5 million in damages plus interest. Representatives for 4 13 Solutions could not be reached for comment.
