A federal judge in San Jose refused to dismiss Apple's lawsuit against former engineer Chen Shi, ruling the tech giant plausibly alleged he took Apple Watch health-sensor trade secrets to rival companies Oppo and InnoPeak.
Judge Eumi Lee's order details Apple's claim that Shi downloaded 63 documents from a protected folder late at night, three days before leaving, then moved them to a USB drive the day before his exit. Apple says Oppo's health division head recruited Shi and presented the material to rival engineers in exchange for a job and salary.
Apple says it spent hundreds of millions developing the Watch's heart rate, blood oxygen, and rhythm-detection features. The court has yet to rule on Apple's separate request to force Oppo to quarantine exposed employees and audit its systems.
