The Ninth Circuit declined Amazon's request for en banc rehearing of its ruling that vacated an injunction against Perplexity's Comet AI Assistant entering password-protected parts of the Amazon store. No judge requested a vote on rehearing.

In August, the court had already found Amazon unlikely to prove Perplexity violated federal or California computer fraud laws, leaving the assistant free to keep operating as the case proceeds.
