HUD flails in push for DEI limits to housing

A federal judge in Oakland refused to dismiss a lawsuit from Los Angeles, San Francisco, San Diego, Baltimore and Salem, Colorado, challenging a Trump executive order that would strip federal housing money from agencies running DEI programs. The administration had argued the case duplicated a separate Washington state lawsuit over different HUD grants, and asked to move it there anyway.

U.S. District Judge Jon Tigar rejected both the dismissal and the venue change, noting the two suits involve distinct grants and distinct plaintiffs, even though the underlying DEI conditions have shown up in lawsuits nationwide. A related case from May, covering homelessness and AIDS housing grants, already produced a preliminary injunction that remains in effect.

Tigar had previously called the funding conditions in this case 'vague' and issued a temporary restraining order in October. The parties did not comment on Monday's ruling.

When the government's best argument for tossing a lawsuit is that it's already facing the same complaint somewhere else, that is not a legal strategy, that is an admission. A policy that spawns copycat lawsuits in city after city isn't unlucky, it's just badly built, like a fence that falls down every time it rains. The judge saw through the shuffle, and it cost the government nothing to try.
