Administrative judge sides with teacher punished for Charlie Kirk Facebook post

An administrative law judge recommended Florida drop charges, including gross immorality, against Duval County teacher Hope McMath over a Facebook post she made after Charlie Kirk's killing. The state had also cited a repost depicting a figure holding a severed head resembling President Trump, but Judge Garnett Chisenhall found no evidence the posts impaired her effectiveness or reached students.

McMath's principal told investigators the posts never came up at school among students, teachers, or parents beyond general news awareness. The judge noted the state never argued the post was a genuine threat to the president, and no complaints were filed by anyone connected to the school.

McMath, reassigned away from teaching duties since the incident, is also pursuing a federal lawsuit against the district, the state education department, and Moms for Liberty alleging retaliation and viewpoint discrimination. A Florida biologist fired over a similar post was recently paid half a million dollars by the state in settlement.
