A federal court in Massachusetts ruled the Social Security Administration provided an incomplete administrative record in a challenge over its decision to share personal information on 700,000 non-citizens with the Department of Homeland Security.

The missing material is needed to determine whether SSA improperly shared confidential tax information protected under the Internal Revenue Code.

The court ordered both SSA and DHS to produce communications between officials about the data transfer, along with any documents showing what role DOGE played in the request being considered at all.

The ruling doesn't resolve the underlying legality of the transfer, but it forces both agencies to show their work before the court decides.

An agency that hands over data on 700,000 people and then can't produce the paperwork explaining why is not a technical glitch, it's a pattern with a name. The court asking DOGE to show its homework is the most restrained possible response to an administrative record that reads like it was assembled after the fact.
