Latino advocacy and voting rights groups sued in federal court to block a Trump administration policy allowing ICE officers to enter polling locations for immigration enforcement during the 2026 midterms.

The suit cites a federal law barring armed federal “troops” or “armed men” at polling sites except to repel armed enemies of the United States, arguing Homeland Security Secretary Markwayne Mullin's stated policy violates it.

Mullin has said ICE presence would be limited to “specific threats” or serving warrants on people already being tracked, while DHS did not respond to a request for comment on the lawsuit.

A law from another era about armed men near ballot boxes is getting tested against a modern claim that agents will only show up for “specific threats,” whatever that ends up meaning on the ground. Telling voters not to worry because the guns are only there for warrants is not the reassurance it's dressed up as. If the goal really were public safety, there are quieter ways to serve a warrant than parking outside a polling place on Election Day.
