Man shot by ICE in Austin in detention facility with bullet still in body

Wilber Rafael Garces Perez, a 28-year-old Venezuelan shot by a federal agent in Austin, remains in ICE custody in Pearsall, Texas, with a bullet still lodged near his spine, according to his attorney Kate Lincoln-Goldfinch, who has filed a habeas petition and says he's being held in a cold room without a bed.

DHS posted on X that he entered illegally under the Biden administration and is pending removal; Lincoln-Goldfinch says he entered legally via the CBP One app in 2024 and only got a removal order because a hearing notice went to the wrong address. DHS has not responded to requests for comment on his medical treatment.

Garces Perez says he was delivering for DoorDash when an ICE SUV rammed his car before agents shot him; Austin's mayor and local Democratic officials are calling for an independent investigation, noting this is the third ICE-involved shooting in Texas.
