The Supreme Court on Thursday declined to take suo motu cognisance of allegedly derogatory remarks made by BJP Rajya Sabha MP Nagendra Roy about Netaji Subhash Chandra Bose, after a lawyer asked Chief Justice Surya Kant to intervene directly.
CJI Kant told the lawyer he was capable enough to simply file a petition himself, noting suo motu action is reserved for cases where affected parties genuinely cannot approach the courts, citing an elderly widow and her blind son as an example of that threshold.
The lawyer pointed to the Court's earlier suo motu action over an NCERT textbook as precedent, but Justice Joymalya Bagchi said any hate-speech allegation would need to be examined through established principles via a proper petition.
