The World Professional Association for Transgender Health is fighting a lawsuit from the FTC and four state attorneys general, who allege its Standards of Care deceptively promoted gender-affirming procedures. WPATH's motion to dismiss argues the standards are 'opinion' protected by the First Amendment, citing 'medical and scientific uncertainty.'

The filing invokes the Supreme Court's Skrmetti ruling upholding state bans on such care for minors — a decision WPATH previously condemned as 'a dangerous setback.' It now cites that same ruling to argue states have legitimate flexibility to regulate the issue.

WPATH's brief also concedes there are 'parties on both sides of this medical debate,' naming dissenting researcher Dr. Hilary Cass, and acknowledges HHS's report finding 'extremely weak evidence' of benefit for minors. The FTC's suit, filed in June, remains pending.

An organization can either be the unimpeachable scientific consensus or a reasonable opinion in an ongoing medical debate, but courtroom strategy apparently allows it to be whichever one wins that week. Groups that spent years insisting disagreement was dangerous now find nuance awfully convenient once the subpoenas arrive. Credibility, it turns out, is not a renewable resource.
