Transgender student drops lawsuit challenging SC’s school bathroom law

A transgender high school student who sued South Carolina in November 2024 over a law barring transgender students from using bathrooms matching their gender identity has dropped the case after moving out of state. His attorneys at Public Justice say he withdrew from in-person classes and faced bullying and transphobic harassment, though Berkeley County school officials dispute that characterization.

The case had been on hold while the Supreme Court considered a separate case on transgender athletes; that June 30 ruling, upholding bans in Idaho and West Virginia, also affirmed South Carolina's similar law. Before a court deadline to argue how that ruling applied, the student withdrew his suit, marking the second time a South Carolina transgender-rights challenge has ended without a ruling — the ACLU dropped a similar youth-treatment-ban case last year.
