The Fifth Circuit ruled that a Texas federal court wrongly sidestepped a dispute between lakefront homeowners and the city of Austin, which classified their properties as subject to full city taxation despite providing them fewer municipal services. The lower court had leaned on unresolved questions of state law to avoid the case.

The appeals court found the homeowners' equal protection claim stands on its own federal footing and doesn't require untangling any disputed Texas law first, sending the case back for an actual ruling.

Austin wants the tax money that comes with calling these lakefront lots full city residents, but apparently not the sidewalk or the streetlight that's supposed to come with it. A federal court kicking the question down the road for years doesn't make the bill any smaller for the people paying it. Sometimes the simplest read of a case is also the right one, and it took an appeals court to say so out loud.
