The National Republican Congressional and Senatorial Committees filed an emergency Supreme Court application to block a Fourth Circuit ruling limiting discounted 'lowest unit charge' campaign ad rates to individual candidates, not party committees. The fight traces to a March FCC media bureau notice extending the discount to party and joint fundraising committees, which Democratic candidates including Jon Ossoff, Sherrod Brown and Roy Cooper successfully challenged.

Because Republican party committees typically raise more money than individual GOP candidates, while the reverse holds for Democrats, the March guidance would have tilted ad-buying power toward the GOP. Republicans argue the appeals court's ruling conflicts with the Supreme Court's own recent decision striking down party-candidate coordinated spending limits, and are urging the justices to act before Friday, when the rate period begins.

Republicans contend the FCC notice was merely 'interpretive guidance' not subject to judicial review, while framing the Fourth Circuit's enforcement of it as an unconstitutional restriction on political speech.

✒ FROM THE EDITORIAL DESK
Both sides insist they're defending free speech in this fight, but the actual dispute is about which party gets the cheaper ad rate, dressed up in enough First Amendment language to make it sound principled. The Supreme Court's own recent ruling conveniently set the table for this appeal, which is either a coincidence or the whole plan.
