Eli Lilly lawsuit against weight-loss drug seller gets another shave

A federal judge in San Francisco dismissed Eli Lilly's false-advertising claims under the Lanham Act against Mochi Health and its pharmacy supplier Aequita, while allowing state unfair-competition claims to proceed. Lilly alleges Mochi Health, which sells compounded versions of Zepbound and Mounjaro, let business staff rather than doctors alter medication doses to cut costs.

Judge Jacqueline Scott Corley found enough evidence that Aequita, controlled by the husband of Mochi Health's CEO, knew of and profited from the arrangement to let the corporate-practice-of-medicine claims move forward. But she ruled Lilly hadn't shown the companies conspired specifically to falsely advertise the drugs, closing that avenue unless new evidence surfaces.

An Eli Lilly spokesperson said the ruling ‘confirms’ the company can proceed on its claims, framing a partial dismissal as validation. The defendants did not respond to requests for comment.

Getting two out of three claims tossed and calling it a confirmation is a neat trick, the kind of thing you'd expect from a fellow who loses two hands of cards and brags about the one he won. The actual news here is a judge finding it plausible that a husband-and-wife business arrangement was cutting corners on how medicine gets dosed. That's worth more attention than either side's press quote.
