Chrisanna Elser has filed a federal class action against Flock Safety and the towns of Columbine Valley and Bow Mar, Colorado, after automatic license plate readers captured her truck near a package theft and police cited her for the crime. Elser says she had no idea the cameras existed until she was already under investigation, and that she didn't resemble the woman on the homeowner's doorbell camera, footage police initially withheld from her.
Elser says she offered an alibi placing her a quarter mile away being fitted for a dress at the time of the theft, but police initially ignored it; the summons was eventually dropped, though she says she suffered emotional distress and nearly faced administrative leave from her employer. Her 64-page complaint argues officers had unrestricted, warrantless access to Flock's database with no probable cause requirement.
Her attorney also represents a separate group of Boulder residents challenging what the suit calls one of the largest mass surveillance networks in the country. Flock Safety, Columbine Valley and Bow Mar have not commented or responded to the lawsuit.
