A federal court in Illinois refused to toss a proposed class action against Kraft Heinz over Philadelphia Cheesecake Crumble desserts labeled as having ‘no artificial preservatives.’ Consumers allege the products contain lactic acid that is artificially produced and functions as a preservative anyway.

The court found the claim plausible enough to proceed, meaning Kraft Heinz will have to defend the label rather than get the case dismissed outright.

A dessert box that brags about what is not inside it is still making a promise, and promises get read closely by people with law degrees. If the acid in your cheesecake is doing preservative work under an alias, calling it natural is a bit like calling a toupee a haircut. The label writers will find out in discovery whether the jury agrees.
