TikTok wants state’s suit dismissed, responds to state ban on minor social media use

TikTok filed a 52-page response seeking dismissal of Florida Attorney General James Uthmeier's lawsuit, arguing HB 3, which bans social media use for children under 14 and requires parental consent for 14- and 15-year-olds, is unconstitutionally vague and violates free speech protections. The company says it already requires parental permission for users under 18 and has begun suspending accounts under 14.

TikTok argues the law fails to specify what form parental consent must take, comparing itself to 24/7 television programming to challenge the law's targeting of features like autoplay and infinite scroll. Uthmeier, appointed by Governor DeSantis in 2025, is seeking damages potentially in the billions and a declaration that TikTok is a public nuisance; TikTok counters the state hasn't alleged actual damages.

A company built on endless scroll is now telling a judge it doesn't know what compliance would even look like, which is a neat trick if you can manage it. Meanwhile the attorney general who filed this suit hasn't found time to look at utility rate hikes that hit every household in the state, addictive or not. Somebody's picking easy fights instead of hard ones, and it isn't the app.
