The Trump administration filed a Federal Register notice proposing to exclude noncitizens without green cards from the 2030 census, a change that could remove millions of people from population counts used to allocate federal funding and House seats. The proposal also strips questions on race, ethnicity, and sexual orientation while adding a citizenship question the administration has pushed since Trump’s first term, and which the Supreme Court blocked from the 2020 census.

The administration’s stated rationale is that noncitizens without green cards lack ‘sufficient tie and allegiance’ to the country to count as ‘true inhabitants.’ The 14th Amendment, meanwhile, directs that representatives be apportioned by the ‘whole number of persons in each State,’ with no carve-out for immigration status beyond untaxed Native Americans.

Public comment runs 30 days from Thursday's official publication, and legal challenges are widely expected given the direct conflict with constitutional text that has stood since 1868.

The Constitution says “whole number of persons,” which is about as slippery as a fence post. When a government starts sorting people into ones who count and ones who don't, it isn't hunting for a better headcount, it's hunting for a better map. Thirty days of public comment on a document that's been sitting there since 1868 seems generous of them.
