Court announces cases it will hear in November, including religious discrimination dispute

The Supreme Court released its November argument calendar, scheduling seven hours of oral argument across five days between Nov. 2 and Nov. 10. Headliners include St. Mary Catholic Parish v. Roy, over whether excluding a Catholic preschool from Colorado's universal preschool program violates the First Amendment because the school wanted an exemption from admitting LGBTQ students and children of LGBTQ parents, and Nielsen v. Watanabe, testing whether a federal inmate can sue prison officials over an allegedly fractured coccyx and denied medical care.

Other cases on the docket include a habeas dispute over First Step Act time credits, a death-row inmate's intellectual disability claim, a fight over eminent domain compensation for natural gas pipelines, and whether the Department of Labor can penalize employers who violate seasonal farm worker visa rules. The preschool case in particular will test how far the Court's 1990 Employment Division v. Smith precedent bends for religious institutions seeking exemptions from neutral, generally applicable rules.
