Federal judge upholds NJ Gov. Sherrill order barring ICE from some state property

A federal judge upheld Governor Mikie Sherrill's executive order barring immigration officials from nonpublic parts of New Jersey state property absent judicial warrants, ruling the Trump administration failed to prove the order discriminates against federal authorities. Judge Georgette Castner found the cited federal statutes impose no duty on states to cooperate with immigration enforcement, and that Congress designed such assistance to be voluntary.

Castner rejected the administration's argument that the order improperly regulates the federal government, finding New Jersey acted as a property owner rather than a regulator. She also found no evidence immigration officers rely almost exclusively on state property, meaning the order does not substantially interfere with enforcement.

The government sued a state for choosing not to help it, then argued that not helping counted as discrimination. A judge looked at that logic and found it about as sturdy as a barn built on sand. New Jersey didn't stop anybody from doing their job, it just declined to lend a hand, which last anyone checked was still allowed.
