A federal judge in Boston, Allison Burroughs, cleared the way Friday for the Department of Homeland Security to end Temporary Protected Status for roughly 1,100 Somalis, following a June Supreme Court ruling that curtailed judicial review of similar terminations for Haiti and Syria. Two other judges last week allowed the same for South Sudan and Myanmar, leaving only Ethiopia's TPS still blocked.
Former DHS Secretary Kristi Noem announced the plan to end Somali TPS in January, citing improved conditions despite continuing fighting between Somali forces and al-Shabaab. Burroughs had blocked the move in March after four Somalis and two advocacy groups sued, alleging the decision was driven by bias, pointing to Trump's past remarks calling Somalis 'garbage' and 'low IQ people.'
Burroughs is now considering whether plaintiffs can still challenge the DHS action on grounds the Supreme Court's ruling left unaddressed.
