A federal judge in San Francisco partly denied the government's motion to dismiss a lawsuit from 14 states over the CDC's decision to strip universal recommendation from seven childhood vaccines, including a hepatitis B birth dose that's up to 90% effective.
Judge Vince Chhabria ruled the states plausibly showed the changes, made at HHS Secretary Robert F. Kennedy Jr.'s recommendation, will predictably reduce vaccine uptake and impose real administrative and financial costs on states that must fill gaps in federal guidance.
He dismissed the states' bid to void all 13 of Kennedy's appointments to the vaccine advisory committee for lack of standing, though he gave them 21 days to amend, while a separate Massachusetts case has already blocked related changes.

A judge just said, in polite legal language, that shuffling a vaccine schedule around has consequences you can count in dollars and hospital beds, which shouldn't need a court order to establish. The part about who got hand-picked to sit on the advisory committee got tossed on a technicality, not a compliment. That's a thin reed to hang public health confidence on, but it's the reed we've got for now.
