A federal court in Illinois partially dismissed a civil rights suit by a legal hemp distributor whose inventory was seized during a traffic stop despite his attempt to show documentation.

The court allowed the failure-to-train claim to proceed, finding the county never educated its officers on distinguishing legal hemp from illegal marijuana.

His tortious interference claims were dismissed on governmental immunity grounds, as the officers' conduct did not rise to the level of 'willful.'

A county that never bothered training officers to tell a legal crop from an illegal one gets to call the resulting seizure merely negligent rather than willful, which is a fine distinction if you're the one holding the badge and not the one holding the now-seized hemp. The paperwork apparently didn't matter either way.
