Whistleblower Protection: DHS Should Ensure Timely Resolution of Retaliation Complaints

A GAO review found the DHS Office of Inspector General took over three years to investigate the majority of whistleblower retaliation cases, 39 of 73, opened and closed between fiscal years 2018 and 2025. OIG officials cited case complexity and limited staff, and said they prioritized thoroughness over speed, but GAO found OIG has never defined its timeliness goal in measurable terms.

Of the 73 cases, 11 were substantiated, and by law the DHS Secretary was supposed to decide on corrective action within 30 days of each. Instead those decisions took anywhere from four months to over two years, and as of May 2026, six of the eleven still awaited a decision, with no official assigned responsibility for ensuring timely review.

GAO made three recommendations, one to OIG and two to DHS, to improve timeliness of investigations and corrective-action decisions; both DHS and its OIG agreed.

A law that gives the Secretary 30 days to act somehow stretched into two years for some cases, with nobody in charge of noticing the clock was running. Whistleblowers who take a career risk to report wrongdoing are being told, in effect, to wait and see, sometimes for longer than a full presidential term change. Agreeing that timeliness matters is cheap; the whistleblowers who filed complaints years ago are still waiting for it to mean something.
