Justice Brett Kavanaugh declined an emergency application from backers of a Michigan citizens-only voting ballot measure, leaving it off the November ballot after the state's Board of Canvassers deadlocked over rejected signatures. The sponsors wanted the Supreme Court to intervene before the state's own high court had even ruled, arguing petition signers' due process rights were violated over late-filed affidavits.

Michigan's response called the request an attempt to grab all possible relief without addressing the pile of invalid signatures behind it. The state Supreme Court, the normal venue, had only accepted amicus briefs and issued no ruling by the time the ballot deadline arrived Friday. The measure would have imposed strict voter ID rules that opponents say risked disenfranchising legal voters.

Skipping the state courts and running straight to the Supreme Court to get an answer before anyone's actually answered the question is a bold way to do business, and it didn't work. When your case can't survive its own hometown court, going over its head rarely fixes that. The docket entry had no opinion attached, which is its own kind of statement.
