A federal court in San Diego declined to dismiss class action false advertising claims against air purifier maker Alen, which marketed products as HEPA-grade despite what the court found was no evidence the company ran the industry tests required to support that label. The suit challenges Alen's use of terms including 'True HEPA' and 'medical grade.'

The court found an average consumer could reasonably have been misled by the marketing, allowing the case to move forward.

Selling an air filter as medical grade without the paperwork to back it up is a bit like a farmer calling his fence bull-proof because he's never seen a bull test it. The label did the work the testing was supposed to do. Now a judge is asking to see the receipts, which is usually the point where the fancier words start disappearing from the box.
