A California Court of Appeal reversed a trial judge Thursday and threw out Dan Schneider's defamation suit against Warner Bros. Discovery over the documentary ‘Quiet on Set: The Dark Side of Kids TV.’ The panel found no evidence the series implied Schneider committed child sexual abuse, distinguishing that accusation, leveled against three other named individuals, from the harassment and toxic-workplace claims made against Schneider himself.

The documentary accuses Schneider of gender discrimination, harassment, and creating a hostile environment, including having underage actors appear in sexualized scenarios; a 2018 Nickelodeon investigation found no evidence of sexual misconduct but he was fired for controlling and verbally abusive behavior anyway. Schneider called the series a ‘hit job’ and pointed to social media reactions as proof of defamatory implication, an argument the court rejected outright as legally irrelevant.

Warner Bros. argued that letting the suit proceed would chill investigative journalism about multiple forms of misconduct within a single program. The court agreed, closing out Schneider's bid to hold the documentary accountable for conclusions it never actually drew.

A documentary can say a man ran a miserable, demeaning workplace without also saying he did the worst thing named in the same hour of television, and apparently that distinction only needed three judges and two years to get confirmed. Suing over what an audience might have inferred, rather than what was actually said, is a bet that outrage will do the lawyering for you. This time the court read the transcript instead of the group chat.
