Overdoses and Good Samaritan immunity

The Virginia Court of Appeals ruled that a woman indicted for meth possession is not entitled to Good Samaritan immunity, because she was not actually experiencing an overdose when a 7-Eleven employee called emergency services out of concern for her.

The immunity statute is written to protect people who are having an overdose from being prosecuted when someone calls for help. Because the clerk's suspicion, not an actual medical event, triggered the 911 call, the court found the protection does not apply.
