The Democratic National Committee filed a FOIA lawsuit against the Justice Department after the FBI refused to turn over documents about any plans to seize ballots or voting machines within a month of the midterms. The request followed the FBI's January raid on the Fulton County, Georgia election office, where agents seized hundreds of thousands of 2020 ballots based on a warrant a federal judge later called 'defective in some respects' and 'troubling.'

The FBI closed the DNC's February request as 'too vague' in March, then reportedly refused further cooperation and pointed only to an administrative appeal, which the DNC filed in April without further response. The DNC also cites DOJ's push to collect voter rolls from all 50 states and the gutting of the Public Integrity Section as evidence the department has weakened safeguards ahead of certification.

An agency capable of seizing hundreds of thousands of ballots on a warrant a judge called troubling apparently cannot locate its own records on whether it plans to do it again. That's not vagueness, that's a filing system that only works in one direction.
