Trump administration faces second lawsuit to block ICE agents at polls

A coalition of nine civil rights and labor groups, including the NAACP and SEIU, sued the Trump administration Friday in federal court in Washington to block ICE agents from entering polling locations during the November midterms. It is the second such lawsuit this month, filed after Homeland Security Secretary Markwayne Mullin said agents could conduct immigration enforcement at polling places and FBI Director Kash Patel declined to rule out sending FBI agents there too.

The groups argue the policy violates a federal law restricting ‘armed men’ at election sites to cases of repelling armed enemies, and the Voting Rights Act's ban on voter intimidation. NAACP general counsel Kristen Clarke called the plan an attempt to convert polling sites into militarized zones.

Neither the Department of Homeland Security nor the Department of Justice responded to requests for comment.

A law written to keep soldiers out of polling places unless they're repelling an invasion is now being tested against agents checking papers at the ballot box, which tells you something about the distance between the statute's intent and the administration's reading of it. Two lawsuits in one month on the same question isn't noise, it's a pattern people are worried enough to sue over twice. Whether a courtroom fixes what a press conference started is the only question left.
