NYC faces wrongful death suit over fatal fall at Hudson Tunnel construction site

The family of Jorge Sanchez Garcia, a 52-year-old concrete worker who fell at least 40 feet to his death last October at the Hudson Tunnel project site, filed a wrongful death lawsuit Monday against New York City, the MTA, the Port Authority, the Gateway Development Commission, Amtrak, and the project's construction firms. The complaint alleges he lacked adequate fall protection including scaffolding, guardrails, and a harness system.

Sanchez, an immigrant from Honduras employed by New York Concrete Corporation, is survived by his wife and four children. The lawsuit seeks undisclosed damages for wrongful death, negligence, and labor law violations, though it does not address earlier reporting that he had worked long overtime shifts, including one lasting 35 hours, before the fall.

The $16 billion Hudson Tunnel project has separately faced funding disputes this year after the Trump administration attempted to freeze federal money over DEI compliance concerns, a move a federal judge found was likely political retaliation tied to budget negotiations with Senate Democratic Leader Chuck Schumer.
