Spat between justices deepens Brazil Supreme Court crisis

Brazil's Supreme Court spent Tuesday in open warfare between Justices Alexandre de Moraes and André Mendonça, who accused each other of abusing their power amid an investigation into an alleged multibillion-real fraud scheme at Banco Master.

Mendonça released a police report naming de Moraes a possible contact of the bank's former owner; de Moraes retaliated by demanding Mendonça be investigated for abuse of authority and misconduct. The court adjourned without deciding how to handle either claim, with two justices recused and one, Flávio Dino, requesting up to 90 days before the case returns to the full bench.

The dispute lands three weeks before Brazil's October election, tangled with the coup conviction of former President Jair Bolsonaro that de Moraes oversaw. Both Bolsonaro's son and President Lula have already worked the feud into their campaigns.

A high court that cannot agree on its own paperwork before an election is not exactly a picture of steady hands on the wheel. When the referees start accusing each other of abuse of authority, everybody else just watches to see which side blinks first, and calls it justice either way. Ninety days is a long time to leave a fight unrefereed, especially with a national vote sitting right in the middle of it.
