Man shot by Border Patrol agents in Portland released

Luis Niño-Moncada was sentenced to time served and released after nearly nine months in federal custody, following a January altercation in which unmarked, plainclothes Border Patrol agents approached his parked truck outside a Portland medical facility to question his passenger, Yorlenys Betzabeth Zambrano-Contreras, about a shooting.

As Niño-Moncada tried to maneuver the truck free, an agent fired twice, wounding him in the arm and chest; Zambrano-Contreras was also shot. He fled, called 911 himself, and was treated at a hospital before being charged with assaulting a federal officer and destroying federal property, the first charge later dropped.

Niño-Moncada, who says he fled political violence and torture in Venezuela, told the court he still loves the United States despite thinking he was about to be killed. He now owes $24,413 restitution for the totaled Border Patrol vehicle and, under his plea deal, cannot contest his coming deportation.
